inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail). You can use the attached model withdrawal form for this purpose, but it is not mandatory.

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

CONSEQUENCES OF REVOCATION

If you revoke this contract, we will repay you all payments received from you, less the delivery costs (and any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we received notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless explicitly agreed otherwise; in no case will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is earlier.

You must return or hand over the goods to us, Himalaya Textilhandels GmbH, Röthbargweg 2b, 22145 Braak bei Hamburg, immediately and in any case no later than fourteen days from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. We will bear the costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to handling them in a way that is not necessary to check the condition, properties and functionality of the goods.

(2) Exclusion of the right of withdrawal

We would like to point out that a right of withdrawal according to § 312g paragraph 2 sentence 1 BGB does not exist, among other things, for contracts for the supply of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer (§ 312g paragraph 2 sentence 1 no. 1 BGB). For such contracts, you cannot revoke the contract. § 312g paragraph 2 sentence 1 BGB provides for further cases in which a statutory right of withdrawal does not exist, but these are not relevant to the contracts concluded via this online shop.
