1. Scope
(1) These General Terms and Conditions apply to all orders placed by consumers through our online shop. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business, or profession (§13 German Civil Code).
(2) The offers in this online shop are directed exclusively at consumers.
2. Contracting Party, Conclusion of Contract, Delivery Area
(1) The contracting party is Himalaya Textilhandels GmbH, Röthbargweg 2b (Bei der Braaker Mühle), 22145 Braak near Hamburg, Germany.
(2) The presentation of products in our online shop does not constitute a legally binding offer but an invitation to place an order. You submit a binding offer to enter into a purchase contract by clicking the “Buy Now” button. You can cancel or correct your entries at any time before submitting the order.
(3) Immediately after submitting your order, you will receive an order confirmation by email. This does not yet constitute acceptance of your offer. The contract is only concluded upon our order confirmation, shipping confirmation, or delivery of the goods.
(4) You must provide all required information (e.g., name, address, email, payment details) truthfully and completely.
(5) Deliveries are made within the European Union. For inquiries from other countries, please contact us by phone or email.
3. Prices and Shipping Costs
(1) All prices are final prices in euros, including statutory VAT, plus shipping costs.
(2) The applicable shipping costs are listed under the link “Shipping Costs” and will be displayed during the checkout process.

4. Payment
(1) Available payment methods are displayed in the online shop and can be selected during checkout. We reserve the right to restrict certain payment methods based on specific conditions (e.g., credit check).
(2) Advance Payment: Our bank details will be provided in the order confirmation; shipment occurs after receipt of payment.
Credit Card: Your card will be charged when the goods are shipped.
PayPal: Payment is processed via PayPal in accordance with their terms and conditions. PayPal’s own privacy and usage terms apply.
Klarna Pay Later (Invoice): Managed by Klarna Bank AB (publ). After selecting this option, you will be redirected to Klarna’s website. Klarna performs an identity and credit check and decides independently on approval. Payment term: 14 days from dispatch. We do not charge additional fees. Late payment may incur interest and reminder fees charged by Klarna. For questions regarding your invoice or payment, please contact Klarna directly.
5. Delivery
(1) Delivery time within Germany for immediately available items: 2–4 business days after contract conclusion or payment receipt (for advance payment).
(2) If we are not supplied on time by our supplier through no fault of our own, we are entitled to withdraw from the contract. In such cases, we will inform you immediately and refund any payments already made.
6. Packaging Return Information
We participate in a dual recycling system. Consumers may return packaging materials free of charge in accordance with the German Packaging Act (VerpackG).
7. Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal. Please refer to our Withdrawal Policy and Model Withdrawal Form for details.

8. Retention of Title
The goods remain our property until full payment has been received.
9. Warranty (Defects Liability)
(1) Statutory warranty rights apply (§§ 434 ff., 437 German Civil Code), including statutory limitation periods.
(2) If an additional manufacturer’s warranty exists, details will be provided in the product description and/or with the delivery. Statutory rights remain unaffected by any warranty.
10. Availability of Terms, Storage of Contract Text, Contract Language
(1) You can save or print your order summary immediately after placing your order. You will receive the order details, legally required information, and these Terms by email.
(2) Registered customers can view previous orders in their account; however, the complete contract text is not stored permanently for security reasons.
(3) Contract language: German.
11. Data Protection
(1) We process your personal data in accordance with applicable data protection laws to fulfill your order. Please refer to our Privacy Policy for details.

(2) You have the right to access, rectify, erase, restrict processing, object, and data portability within the limits of the law.
12. Alternative Dispute Resolution

We are not obliged or willing to participate in dispute resolution procedures before a consumer arbitration board.
13. Applicable Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law applies only if it does not deprive consumers of the protection granted by mandatory laws of their country of residence.
